The Demanding of Truly Free Paste Spots

In Rotterdam it is utterly impossible to make propaganda making use of the so called free paste spote, because those are illegaly misused by commerical parties for commercial ends. Coming Wednesday the Commision on Neighbourhoods and Public Spaces will be questioned to get the phenomenon of the free paste spots into the spot-light.

Coming Wednesday the Cities' Commision on Neighbourhoods an Public Spaces (Commissie Wijken en Buitenruimte) will be questioned about the phenomenon of the - to be freely translated as the - 'free paste spots'! By the way, by making these questions, no value judgements are intended concering clandestine pasting tactics.

What are free paste spots?
As you might know - or guess - it is not (officially) allowed to paste your radical left wing propaganda or any other propaganda in the public spaces. This is juridically taken care of in the APV (Algemene Plaatselijke Verordening), more specific in article 2.4.2. There are Treaties that say that governments must ensure the right to freedom of expression, also for means making use of the bucket and brush ('emmer en kwast').

Because of article 10 of the European Convention on Human Rights it is illegal for national and local governments to have an absolute prohibition on the public use of bucket and brush. So the existance of the free paste spots had to be ensured to make controlling pasting activities legally possible. At the same time, it is ordonanced that using the free paste spots for commercial ends is illegal. Nevertheless our collective free paste spots are misused by commercial cultural establishment for almost-free advertising. Even specialized pasting entrepeneurs are used for these ends and those also compete amongst each other. This means that any physical efforts to the pasting of moral messages or socially engaged announcements will not exist long before they are over-pasted. With the coming elections in March 2006, this practice is everything but a strategic advantage for anyone who wants to make campaign for anything other than VVD and Leefbaar Rotterdam.
City will have to account for!
Now the City, and more in particular: a special Commission on Neighbourhoods and Public Spaces, will be questioned on this.
They will have to answer to the following questions:

1) In weerwil tot het bepaalde in lid 5 van artikel 2.4.2 van de APV
Rotterdam (plakken en kladden) worden de vrije plakplaatsen gebruikt
voor handelsreclame, zelfs in zo'n overwegende mate dat er als ideële
plakker niet tegen op te plakken valt. Veelal op winst gerichte
culturele ondernemingen (waaronder ook door de Gemeente Rotterdam
gesubsidiëerde instellingen) schakelen commerciële professionele
plakbedrijven in die zelfs elkaar de loef proberen af te steken door zo
snel mogelijk over de posters van de concurrent heen te plakken. De
namen van de opdrachtgevers staan - uit der aard - op de posters. Zijn
de leden van de Commissie het met mij eens dat er door deze praktijk in
feite geen gebruik van reële betekenis meer mogelijk is voor de
gebruikmaking van de vrijheid van meningsuiting door middel van
aanplakken in de openbare ruimte?
2) Tegen wildplakken wordt opgetreden. Worden er serieuze pogingen
gedaan om het verbod van het gebruik van vrije plakplaatsen voor
commerciële doeleinden te handhaven? Zo nee, wat is hier de reden voor
en is men het dan niet met mij eens dat er sprake is van selectieve
handhaving?
3) Het schijnt dat de aanwijzing van vrije plakplaatsen aan de
deelgemeenten is overgelaten. Hoe is dit juridisch geregeld en is het
mogelijk als burger invloed uit te oefenen op de aanwijzing van de
locaties van de vrije plakplaatsen?
4) Is het mogelijk dat er meer vrije plakplaatsen komen in werkelijk
druk bezochte gebieden?
